General Terms and Conditions

§ 1 Scope, Customer Information

The following General Terms and Conditions govern the contractual relationship between Luxus Extensions and consumers and entrepreneurs who purchase goods via our shop. We do not recognize any terms and conditions of the entrepreneur that contradict or deviate from our terms and conditions. These GTC also include customer information in accordance with the BGB-Info Regulation. The contract language is German.

§ 2 Conclusion of Contract

(1) The offers on the internet represent a non-binding invitation for you to purchase goods.

(2) After entering your data and clicking the order button, you submit a binding offer to conclude a purchase contract. You can also submit a binding order by telephone.

(3) With the confirmation of receipt sent immediately by email, your offer is also accepted, and the purchase contract is concluded. In the case of a telephone order, the purchase contract is concluded if we accept your offer immediately. If the offer is not accepted immediately, you are no longer bound to it.

§ 3 Customer Information: Storage of Offer Text

The contract text, including details about the item, is stored by us.

§ 4 Customer Information: Correction Notice

You can correct your entries at any time before submitting the order. We inform you about your correction options throughout the order process.

§ 5 Payment Methods

(1) Purchase on account: When purchasing on account, the invoice amount is due for payment on the calendar day specified in the invoice (20 calendar days after the invoice date) to our external partner Billsafe [Link to www.paypal.de]. The payment method “purchase on account” is not available for all offers and requires a successful credit check by Billsafe. If the customer is granted the purchase on account option after a credit check, payment is processed in cooperation with PayPal, to whom we assign our payment claim. In this case, the customer can only make payments with a debt-discharging effect to PayPal. Even with a purchase on account via PayPal, we remain responsible for general customer inquiries (e.g., regarding goods, delivery time, shipping), returns, complaints, revocation declarations and returns, or credits.

§ 6 Retention of Title; Offsetting; Right of Retention

(1) For consumers, we retain ownership of the purchased item until full payment of the invoice amount has been made. If you are an entrepreneur acting in the course of your commercial or independent professional activity, a legal entity under public law, or a special fund under public law, we retain ownership of the purchased item until all outstanding claims from the business relationship with the purchaser have been settled. The corresponding security rights are transferable to third parties.

(2) You are only entitled to offset claims if your counterclaims have been legally established, are undisputed, or have been acknowledged by us. Additionally, you may only exercise a right of retention if and to the extent that your counterclaim arises from the same contractual relationship.

(3) If the customer is in default of any payment obligations towards us, all existing claims shall become immediately due.

§ 7 Liability and Limitations of Liability

Claims for damages against us or our employees are excluded regardless of the legal basis, in particular due to delay or impossibility of delivery, breach of advisory and contractual ancillary obligations, etc., unless there is intent or gross negligence or the claims for damages result from the breach of a guaranteed property. If we are liable in principle, the damages shall be limited to foreseeable damages. In any case, compensation for consequential damages is excluded. Ingredient information on consumer products, e.g., care products, must be checked by the purchaser upon delivery for individual compatibility before use. We are not liable for discrepancies between the information on the respective packaging and the specifications in the product descriptions of the online shop. If the purchaser determines a possible incompatibility based on the ingredient information before use, the right of withdrawal may be exercised.

§ 8 Returns and Right of Withdrawal

For hygiene reasons, returns or exchanges are only possible if the product is unused and returned with an intact seal. Changes such as dyeing, tinting, or the use of silver shampoo exclude the possibility of a return or exchange. We ask our customers to take this into account when using our products.

The warranty is based on legal regulations.
